Overview of New Legal Requirements:
AB 2534 (Effective January 1, 2025)
AB 2534 is a ¹ú²ú´«Ã½ law that strengthens how schools hire and review teachers. It requires anyone applying for a certificated position to share all of their past jobs in education. It also requires school districts to contact those previous employers to find out whether the applicant was ever involved in serious misconduct that had been reported to the ¹ú²ú´«Ã½ Commission on Teacher Credentialing.
SB 848 (Effective January 1, 2026)
SB 848 broadens the rules set by AB 2534 so they apply not only to teachers but also to classified school employees, such as support staff. It also increases the number of people who are required by law to report suspected child abuse, strengthens what schools must include in their safety plans, and adds new requirements for staff training and clear guidelines about appropriate professional behavior in all school settings.
Employment History Requirements
Certificated (AB 2534) and Classified (SB 848) applicants must provide a complete list of all prior educational employers, including:
- Local Education Agencies (LEAs)
- School Districts
- County Offices of Education
- Charter Schools
- State Special Schools
- Other educational institutions, regardless of the length of service
Hiring LEAs must:
- Contact every prior employer
- Request disclosure of any credible complaints, substantiated investigations, or disciplinary actions tied to egregious misconduct
- Obtain copies of all relevant records previously reported to the CTC
Definition of Egregious Misconduct
Under Education Code §44932, egregious misconduct includes:
- Specified sex offenses
- Child abuse or neglect
- Certain controlled‑substance violations
These offenses require reporting to the CTC and disclosure to hiring LEAs.
